All visitors of our sight agree that by accessing this site, they are subject to and agree with the following terms and conditions as well as any other applicable laws associated with these terms and conditions.  If you do not agree with the following please do not use our site.  When this document refers to ‘you’ or ‘your’ it means you, the Consumer. Essential Supplements may be referred to as ‘us’ or ‘we’.  This document, as well as your decision to comply, represents a Contract regarding product supply between You and Us.

Transactions

For all transactions actioned on this site, the following conditions apply.  All transactions are in Australian Dollars.  If you are underage you cannot place online orders from our store.  By accepting these terms and conditions, you acknowledge that you are over the legal age of 18.  If under any circumstance Essential Supplements suffer financial loss due to a transaction completed by a minor, we reserve the right to seek compensation from the parent/s or guardian/s whom we deem responsible for the order being placed.

Orders

You are able to place an order using our online store.  Simply add items you wish to purchase to the cart and check out.  If you have any questions or enquiries regarding an order you would like to place, please do not hesitate to contact us using whichever platform you prefer.  You can complete an online form in the 'Contact Us' section of our site, call us on 0408 039 989 or send us a DM on Instagram or Facebook.  We always endeavour  to respond to messages and emails promptly.

Once your order is received and confirmed by Essential Supplements, you will receive a confirmation email.  This means you accept the Terms and Conditions listed within this document.  Methods used to complete your order include shipping, pick up in store or in some instances, personal delivery by our team.

If for some reason beyond our control, we are unable to fulfil your order, we will contact you to organise an agreed alternative.  We are here to provide you with a specialised service and always aim to satisfy your needs to the best of our ability.

Essential Supplements would like to reserve the right to refuse service, cancel orders terminate accounts or make changes at our own discretion.

Payment Methods and Processing

Essential Supplements accepts Credit Card payments through our online store as well as Zip Pay and Pay Pal.  Payments can also be made via direct deposit.

Orders paid via direct deposit will not be processed until full payment has been received.  Please ensure that you include the order/invoice number in the transaction description.  We will be unable to process your order until the information required to do so has been received. 

Orders placed on public holidays will not begin to be processed and/or shipped until the next business day.  Orders placed over the weekend will likely be processed but cannot be shipped until the next business day - Monday to Friday (not including NSW public holidays).

We may request further identification for additional security reference checks.

GST

All prices quoted on this website are inclusive of GST except for items that are exempt from GST.  Items that include GST and the total GST paid will be clearly marked on the invoice.

Pricing

We always seek to list all our products with the most competitive prices.  We price match with other stores so long as the item is in stock and not part of an exclusive promotion or collaboration.  Essential Supplements reserves the right to change prices for items displayed on our website at any time.  If, on the rare occasion a price is incorrectly displayed, we reserve the right to cancel the order and issue you with a refund.

Products

When your order has been placed, the products chosen by you are subject to these Terms and Conditions.  Once your order has been fulfilled and shipped, we will email you to confirm this as well as provide you with tracking details.

 

 

 

Faulty Products

Essential Supplements only offers the best quality products to our customers.  We take all necessary precautions to supply you with product have ordered in good condition. However, on occasion goods that are sealed within cartons may be faulty as a result of a manufacturing defect from our suppliers.

Limitation of Liability

Information on this website is provided 'as is' and we disclaim all representations, warranties and conditions, express or implied of any kind, including to the extent permitted by law, as to satisfactory quality or fitness for purpose.

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without our prior written consent of Essential Supplements.  Any unauthorised assignment shall be deemed null and void.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.

Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in Essential Supplements for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Essential Supplements, to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s).

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition.  Such failure shall in no way affect the right to later enforce such Term or Condition.

Essential Supplements reserves the right to change the Terms and Conditions of sale at any time.

No Essential Supplements employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

Force Majeure

Essential Supplements shall not be liable for any delay in performing any of its obligations under these Terms and Conditions, if such delay is caused by circumstances beyond the reasonable control of our website, which in turn we shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of NSW and shall be subject to the non-exclusive jurisdiction of the courts of NSW.
